What is the difference between Community Property and Separate Property in California?

Almost any property, debt or asset that you and your spouse obtained during your marriage is considered joint or "community property." This property belongs to both you and your spouse and must be divided during your divorce.

Property that you acquired before your marriage and certain gifts/inheritances that you receive during marriage is considered separate property and is legally yours to keep.

How is Community Property Divided in a California Divorce?

Under California law, community property must be divided "equally." Unless you can come to an agreement about the property, the court will split it in a way that gives each spouse an equal "net value" (financially equal). The court rarely comes to a decision that is better than an agreement between the parties in a divorce.
